  <dc:description xml:lang="srp">Apstrakt: U većini savremenih država krivičnopravno vreme maloletstva traje do navršenih osamnaest godina. Bez obzira na to, ova granica postala
je relativna, sa stvaranjem zakonske mogućnosti primene maloletničkog krivičnog prava i na mlađe punoletne osobe, a do njihove 21. godine. Pravila
maloletničkog krivičnog prava na mlađe punoletne osobe odnosi se na sve faze postupka, sa naglaskom na ulogu službi socijalne zaštite, procenjivanje
zrelosti mlađeg punoletnika, njegov boravak u pritvoru, uključujući i izvršni krivični postupak. Izuzetak od primene pravila opšteg krivičnog zakonodavstva na mlađe punoletne izvršioce treba upravo restriktivno primenjivati.
Međunarodni standardi prema mlađim punoletnim izvršiocima krivičnih dela u većini savremenih zakonodavstava su implementirani u pozitivno zakonodavstvo, i to kako u Republici Srbiji, tako i u zemljama regiona i šire. Pitanja
na koja moraju sudovi da odgovore odnose se na proširenje mogućnosti
maloletničkog prava na mlađe punoletne, ali ipak ne preširoko, kako se ne bi granica maloletstva i neopravdano povećala na 21 godinu života, što je zadatak nauke krivičnog prava i legislative de lege ferenda.</dc:description>
  <dc:description xml:lang="eng">Abstract: In most modern countries, the criminal-legal period of minors lasts until the age of eighteen. Regardless, this limit has become relative,
with the creation of the legal possibility of applying juvenile criminal law to younger adults, up to their 21st year. The rules of juvenile criminal law on younger adults apply to all stages of the procedure, with an emphasis on the role of social protection services, assessing the maturity of a younger adult, his stay in custody, including executive criminal proceedings. The exception to the application of the rules of the general criminal legislation to younger perpetrators should be strictly applied. International standards for underage perpetrators of criminal offenses in most modern legislation have been
implemented in positive legislation, both in the Republic of Serbia and in the countries of the region and beyond. The questions that must be answered by the courts refer to the extension of the possibility of juvenile law to younger
adults, but still not too widely, so that the limit of juvenile is not unjustifiably increased to 21 years of age, which is the task of the science of criminal law
and legislation de lege ferenda.</dc:description>
