  <dc:description xml:lang="srp">Apstrakt: Nezavisnost sudova predstavlja jedno od osnovnih načela u svim oblicima
organizacije vlasti. Uprkos opšteprihvaćenoj proklamaciji nezavisnosti sudske vlasti,
njeno efektivno ostvarenje zavisi od mnoštva pravnih garancija, ali i isto tako još
većeg broja vanpravnih činilaca, prvenstveno tradicije, pravne kulture, sistema
političkih odnosa itd. Jedno je zajedničko, garancije nezavisnosti sudova predstavljaju
bez izuzetka ustavnu materiju, ali se njeno obezbeđenje ostvaruje različitim
instrumentima, a jedan od osnovnih je način izbora sudija. Otuda se u evropskim
državama mogu uočiti najrazličitija rešenja, koja se na osnovu izvesnih zajedničkih
elemenata mogu svrstati u nekoliko dominantnih modela. Ipak, pripadnost istom
modelu ne obezbeđuje iste efekte u različitim državama. U tom pogledu, u svim
razmatranjima stepena ostvarenja nezavisnosti sudova, te institucionalnih slabosti
konkretnog sistema, uglavnom se pravi razlikovanje na države sa razvijenom
pravnom tradicijom i one koje su krajem prošlog veka promenile svoj politički sistem.</dc:description>
  <dc:description xml:lang="eng">Abstract: Court independence is one of the basic principles in all forms of government
organization. Despite the generally accepted proclamation of the independence of the
judiciary, its effective implementation depends on a multitude of legal guarantees,
but also an even greater number of extra-legal elements, primarily traditions, legal
culture, systems of political relations, etc. One is common, guarantees of independence
of courts represent without exception the constitutional substance, but its security is
realized by different instruments, and one of the basic means of election of judges.
Hence, in European countries one can notice the most diverse solutions, which, on
the basis of certain common elements, can be classified into several dominant models.
However, belonging to the same model does not provide the same effects in different
countries. In this regard, in all the considerations of the degree of independence of
courts and institutional weaknesses of the particular system, a distinction is made
between countries with a developed legal tradition and those who changed their
political system at the end of the last century.</dc:description>
