Овај рад се бави правним аспектима заштите деце погођене родно заснованим насиљем и његовим утицајем на наследноправне спорове. Анализом важећих законских оквира идентификујусе кључни недостаци управној заштити деце услучајевима где се насиље и наследни спорови преплићу. Посебан акценат стављен је на примену законских норми у пракси, као и на препреке које отежавајуостваривањеправадецеуовимкомплекснимситуацијама.Раддаљеразматрапостојећемеханизме правне заштите, истичући неопходност унапређења законодавног оквира и јачања интердисциплинарног приступа у решавању ових питања. У том контексту, анализирана је улога правосудних органа, социјалних служби и других стручњака који учествују у процесу заштите деце. Циљ је пружити свеобухватан преглед правних изазова и препорука које могу допринети ефикаснијој заштити деце у наследним поступцима погођеним родно заснованим насиљем. Gender-based violence within the family poses a serious challenge for the legal system, especially in the context of inheritance proceedings. This paper addresses the legal aspects of protecting children affected by gender- based violence and its impact on inheritance disputes. An analysis of the current legal framework identifies key shortcomings in the legal protection of children in cases where violence and inheritance disputes are intertwined. Special emphasis is placed on the application of legal norms in practice, as well as on obstacles that hinder the exercise of children's rights in these complex situations. The paper further discusses the existing mechanisms oflegal protection, highlighting the need to improve the legislative framework and strengthen the interdisciplinary approach in addressing these issues. In this context, the role of judicial authorities, social services and other professionals involved in the child protection process is analyzed.
