Претходни закон је имао мањкавости које биле су непосредна или посредна последица недовољно јасног регулисања предмета јавих набавки: велики број изузетака од његове примене; неусклађеност са директивама Европске уније, нарочито кроз постојање изузетака од примене закона којих у директивама нема, неусаглашеност набавки у комуналном сектору, неусклађеност система заштите права и у вези с тим, недовољна овлашћења, надлежности и капацитети органа који су требали да врше надзор и контролу примене закона. Без сумње, у многим земљама јавни сектор представља највећег купца роба и услуга, па је у позицији да утиче и да креира конкуренцију кроз своје понашање на тржишту. Кроз јавне набавке, држава може да стимулише, али и да негативно утиче на конкуренцију било ког привредног сектора. Предмет уговора о јавној набавци према важећем закону може бити: набавка добара, набавка радова и набавка услуга. Summary: The clear definition of the subject of the public procurement is an important innovation in the current Law on Public Procurements. The previous Law had its shortcomings which were direct or indirect consequences of not clearly enough regulating of the subject of the public procurement; a large number of exceptions of its application, inconsistency with the directives of the European Union, especially through the existence of exceptions of the application of the Law which do not exist in the directives, inconsistency in procurements in the utilities sector, inconsistency within the system of the protection of the rights and concerning that, insufficient authority, competence and capacity of the bodies which were supposed to monitor and control the application of the Law. Without a doubt, in many countries, the public sector represents the biggest purchaser of goods and services, so it is in a position to influence and create the competition through its behaviour in the market. Through the public procurement, the state can stimulate or influence negatively the competition of any commercial sector. The subject of the contract of the public procurement, according to the current Law, can be: the procurement of goods, the procurement of works and procurement of services.
