srp 2017 Резиме: Нужност критичког осврта на постојеће нормативно уређење услуге даљинског грејања у Републици Србији полази од стварних проблема који већ дуги низ година оптерећују не само кориснике, већ и саме вршиоце ове делатности, те стручну јавност, доносиоце одлука и креаторе политике у овој области. Метод анализе релеваnтних правних института и указивање на њихове недостатке, поткрепљен стварним примерима манифестација повреда права крајњих купаца, те приказ досадашњих искустава у остваривању задатих циљева европске енергетске политике, за свој циљ имају синтезу елемената који у овој области коегзистирају у целину која са синергетским ефектом треба да омогући остваривање општег интереса којем ова услуга мора да служи. У складу са захтевима модерног доба у области енергетике, а који почивају на темељу поштовања принципа одрживог развоја и очувања животне средине, ефикасно коришћење енергије представља основни модел понашања и нашу цивилизацијску обавезу према будућим генерацијама. Summary: The existing normative regulation of the remotely controlled heating services in the Republic of Serbia necessitates a thorough critical evaluation. The most pressing challenge includes solving some of the long-standing issues whose endurance creates a considerable setback for the consumers, as well as the service providers, along with the legislators, and decision-and policy-making communities. Our analysis of the relevant legislative achievements is followed by pointing out the deficiencies in the current practices. It is also supported with the examples of violations of the end consumers’ rights; a review of the European energy policies is available as well, with the emphasis on experiences and accomplishments thus far, in comparison with its end objectives. This paper aims to provide a synthesis of several coexisting approaches and practices, and help creating a synergistic framework. Our main goal lies in obtaining the highest level of functionality in this area, in full accordance with the public interest. In regard to the sustainable development principles and its long-term goals of the comprehensive environmental protection, the importance of the energetic efficiency cannot be overstated; it remains our long-term priority, as well as our foremost duty toward the future generations.
