  <dc:description xml:lang="srp">Sažetak: Cilj pisanja rada ogleda se u težnji autora da analizom pozitivnopravnih rešenja u vezi sticanja prava svojine ukažu na pojavne oblike i probleme koji se u praksi javljaju u svezi sticanja prava svojine legalnim putem i načina njene zaštite. Za sticanje subjektivnih prava, gde spada i pravo svojine, neophodno je da se ispune određeni preduslovi koji se tiču postojanja pravnih činjenica na osnovu kojih se pravo svojine može steći. U užem smislu pod načinom sticanja (modus acquirendi)
se podrazumeva postojanje samo jedne pravne činjenice, ukoliko se radi o sticanju svojine na osnovu pravnog posla sa vlasnikom. U zavisnosti od toga da li je stvar, na kojoj se stiče pravo svojine, već u nečijoj svojini razlikuju se apsolutno i relativno sticanje svojine, što u krajnjem ishodu utiče i na načine
njene zaštite, odnosno vrstu svojinske tužbe koja će se podići. Današnja sudska praksa koristi rimski sistem zaštite svojine, od kojih su dve tužbe za zaštitu svojine, a jedna je državinska. Reivindikacionom
tužbom (Actio rei vindicatio) vlasnik stvari zahteva njen povraćaj, dok negatornom tužbom (Actio negatoria) vlasnik tj. držalac zahteva zaštitu protiv uznemiravanja, odnosno, smetanja prava svojine.
Publicijanska tužba (Actio publiciana) savesnog držaoca stvari je pak državinskog karaktera jer se ne dokazuje svojina već samo državina.</dc:description>
  <dc:description xml:lang="eng">Summary: The aim of writing this paper is reflected in the author’s desire to analyze the positive legal solutions regarding the acquisition of property rights to point out the forms and problems that arise in
practice in connection with the acquisition of property rights legally and ways to protect it. In order to acquire subjective rights, including the right to property, it is necessary to meet certain preconditions regarding the existence of legal facts on the basis of which the right can be acquired. In a narrower
sense, the method of acquisition (modus acquirendi) means the existence of only one legal fact, if it is an acquisition of property on the basis of a legal transaction with the owner. Depending on whether
the thing on which the right of ownership is acquired is already in someone’s property, the absolute and relative acquisition of property differs. Ultimately, that also affects the ways of its protection, that is, the type of property lawsuit that will be filed. Today’s case law uses the Roman system of property
protection, two of which are lawsuits for property protection, and one is state lawsuits. With a claim (Actio rei vindicatio) the owner of the thing demands its return, while with a Actio negatoria lawsuit the owner, or the holder, demands protection against harassment, ie interference with property rights.
The Actio publiciana lawsuit of a conscientious holder of things is of a possession character because it is not necessary to prove ownership, but only the possession.</dc:description>
