  <dc:description xml:lang="srp">Sažetak: Shodno odredbi čl. 488 st. 1 Zakona o parničnom postupku, potrošački spor je spor koji proizilazi
iz ugovornog odnosa potrošača i trgovca. Iako je zaštita potrošača Ustavna kategorija, (čl. 90 Ustava
RS), što govori o njenom značaju, potrošački sporovi su retki u domaćem pravosuđu. Ovo iz razloga
jer su građani neretko obeshrabreni da pokreću parnični postupak zbog njegove dugotrajnosti, kao i
troškova koji isti iziskuje, dok je vrednost proizvoda uglavnom mala, a ishod postupka neizvestan.
Novi Zakon o zaštiti potrošača stupio je na snagu 19. septembra 2021. godine, pa iako su odredbe
u velikom delu prepisane iz Zakona o zaštiti potrošača iz 2014. godine, njime se uvodi novina vidu
obaveznog pristupa medijaciji od strane prodavca, a na zahtev potrošača. Iako je medijacija brži
i ekonomičniji način rešavanja sporova, na ovaj način, načelo dobrovoljnosti na kom se temelji
posredovanje, ostaje samo na strani potrošača, od čije dispozicije zavisi da li će se voditi postupak
posredovanja ili sudski postupak.</dc:description>
  <dc:description xml:lang="eng">Summary: Pursuant to the provisions of Art. 488 st. 1 of the Law on Civil Procedure, a consumer dispute
is a dispute arising from the contractual relationship between a consumer and a trader. Although
consumer protection is a constitutional category (Article 90 of the RS Constitution), which speaks of
its importance, consumer disputes are rare in the domestic judiciary. This is because citizens are often
discouraged from initiating litigation due to its longevity, as well as the costs it requires, while the
value of the product is mostly small and the outcome of the procedure is uncertain. The new Consumer
Protection Act entered into force on September 19, 2021, so although the provisions were largely
copied from the 2014 Consumer Protection Act, it introduces a novelty in the form of mandatory
access to mediation by the seller, at the request of consumers. Although mediation is a faster and more economical way of resolving disputes, in this way, the principle of voluntariness on which mediation is
based, remains only on the side of the consumer, whose disposition determines whether mediation or
court proceedings will be conducted.</dc:description>
