  <dc:description xml:lang="srp">Sažetak: Zaštita potrošača je oblast prava kojim se štite osnovna prava građanina koji se nalaze u ulozi potrošača, tj. onih koji pribavljaju za sebe ili drugoga robe i usluge na tržištu. Metod te zaštite bi se mogao opisati kao robusna intervencija javnopravnih institucija u ugovore između potrošača i
privrednih subjekata koji nude robe i usluge. Zato se postavlja pitanje da li ovu narastajući sistem normi treba pozicionirati kao novu granu i disciplinu javnog prava ili samo kao poseban režim obligacionog prava. U uporednom pravu, ova pravasu regulisana jednim osnovnim i opštim zakonom
o zaštiti potrošača, čija je svrha implementacija potrošačkog prava Evropske Unije. Za razliku od država regiona, pozitivnopravno rješenje u Bosni i Hercegovini (BiH) je komplikovano i asimetrično.
Naime, u ovoj složenoj državi važe dva zakona, različitog teritorijalnog domašaja, jedan koji važi na čitavoj teritoriji BiH i drugi koji važi samo u entitetu Republika Srpska. Tako se nameće pitanje da li je ovakvo pozitivnopravno rješenje legalno i svrsishodno. Istorijski, uporednopravni i pravnosistemski argumenti izloženi u ovim radu idu u prilog pravnosistemskog pozicioniranja potrošačkog prava u obligaciono pravo i u prilog donošenja zakona o zaštiti potrošača na svim nivoima vertikalne podjele
vlasti u BiH.</dc:description>
  <dc:description xml:lang="eng">Summary: Consumer protection is an area of law that protects the basic rights of citizens-consumers who procure for themselves goods and services on the market. The method of this protection could be described as a robust intervention of public institutions into contracts between consumers and economic entities that offer goods and services. Therefore, the question arises whether this growing
system of norms should be positioned as a new branch and discipline of public law or only as a special regime of law of obligations. In comparative law, these rights are regulated by one basic and general law on consumer protection, the purpose of which is the implementation of the European Union consumer law. Unlike the countries of the region, in Bosnia and Herzegovina (BiH) the extant solution of the consumer law is complicated and asymmetric. There are two laws of different territorial scope in this complex state, one that is applicable on the entire territory of BiH and the other only in the entity of Republika Srpska. Thus, the question arises as to whether such a positive legal solution is legal and purposeful. Historical, comparative and systemic arguments presented in this paper propose the legal
positioning of consumer law in the obligations law and the adoption of the consumer law at all levels of the vertical division of power in BiH.</dc:description>
