    <ns1:description language="sr">Sažetak: Rad van prostorija poslodavca, koji podrazumeva rad na daljinu i rad od kuće,
predviđen je u važećem Zakonu o radu Republike Srbije i nije nov institut niti nepoznanica u
domaćem pravnom sistemu. Zakonodavac je, u svom određivanju ove vrste rada, imajući u vidu specifičnosti ovakvog rada zaposlenog, taksativno naveo koje sve odredbe treba da sadrži ugovor
o radu, osim onih uobičajnih. Međutim, pandemija i protekli period koji je obeležilo vanredno
stanje, praćeno povremenim uvođenjem policijskog časa i dr., doveli su do toga da je rad od
kuće dobio jednu sasvim novu dimenziju. To bi svakako proizilazilo iz masovnosti i veoma velikog broja zaposlenih koji su radili od kuće duži vremenski period. Takođe, i dalje postoji značajan broj zaposlenih koji stalno ili bar povremeno (određenim danima) rad obavljaju od kuće. Po svemu sudeći, ovakva situacija, ma koliko se činila, u prvi mah, privremenom, ostaće još dugo ovakva, uz povremene modifikacije. Baš iz tog razloga, zakonske odredbe, odnosno
ukupno dva člana zakona posvećena ovoj vrsti rada zahtevaju detaljniju razradu, kako zbog zaposlenih, tako i zbog poslodavaca, ali i zbog radnopravnog sistema u celini. Autori ovog rada će, kroz analizu postojeće regulative, preporuke nadležnog ministarstva i prakse u drugim državama, nastojati da prikažu rad od kuće onakvim kakav je trenutno, u ovim specifičnim uslovima. Međutim, po mnogim predviđanjima, rad od kuće neće izgubiti svoj značaj ni kada se pandemija zvanično završi, pa samim tim aktuelnost ove analize ima svoju opravdanost i vrednost za buduća istraživanja i radnopravnu praksu.</ns1:description>
    <ns1:description language="en">Summary: Work outside the premises of the employer, which includes work at a distance and work from home, is provided for in the valid Labor Law of the Republic of Serbia and is not a new institute or unknown in the domestic legal system. The legislator, in his determination of this type of work, having in mind the specifics of this kind of work of the employee, exhaustively
stated all the provisions that the employment contract should contain, except the usual ones.
However, the pandemic and the past period marked by the state of emergency, followed
by occasional curfews, etc., led to the fact that work from home took on a completely new
dimension. That was certainly resulted from the mass and very large number of employees
who worked from home for a longer period of time. Also, there is still a significant number
of employees who work permanently or at least occasionally (on certain days) from home. Apparently, this situation, no matter how it seemed, at first, temporarily, will remain like this for a long time, with occasional modifications. Precisely for that reason, the legal provisions, ie a total of two articles of the law dedicated to this type of work, require more detailed elaboration, both because of the employees and the employers, but also because of the labor law system as a whole. The authors of this paper will, through the analysis of the existing regulations, recommendations of the competent ministry and practice in other countries, try to present the work from home as it is currently, in these specific conditions. However, according to many predictions, work from home will not lose its significance even when the
pandemic officially ends, so the relevance of this analysis has its justification and value for
future research and labor law practice.</ns1:description>
