o:4612 Истина и њено утврђивање у кривичном поступку Truth and its determination in a criminal procedure sr Summary: Truth and its assessment as a legal and philosophical concept has, for centuries, represented the theme around which people share opinions. In a criminal proceedings, the truth has a special position because of the fact that it determines whether the accused will be found criminally responsible and therefore whether he/she will be sanctioned. According to the fact that there are two legal systems, continental and Anglo-Saxon, they are inter alia differ in the view of the principle of truth in a criminal proceedings. Serbia, as a country that for centuries belongs to the civil law, has changed its attitude towards the principle of truth through the most recent amendments to the criminal procedure legislation bringing into question the validity and constitutionality of the Criminal Procedure Law of 2011. Сажетак: Истина и њено утврђивање, као правни и филозофски појам, вековима представља тему око које се деле мишљења. У кривичном поступку истина има посебан положај јер од ње зависи да ли ће окривљени бити проглашен кривично одговорним па сходно томе да ли ће бити и санкционисан. Како данас постоје два правна система, континентални и англосаксонски, они се између осталог разликују и по гле- дању на начело истине у кривичном поступку. Србија, као држава која вековима припада континенталном праву, најновијим изменама у кривичном процесном законодавству променила је став према начелу истине доводећи у питање исправност и уставност одредаба Закона о кривичном поступку из 2011.године.
