o:4512 Инструменти директног одређивања понашања адресата норми права животне средине Instruments of direct determination of adresees’ behaviour in the field of environmental law sr Abstract: The objectives and principles of environmental law are achieved through appropriate legal and other instruments to ensure the desirable behavior of the corresponding entities. By their nature, these instruments can be direct and indirect. Unlike the indirect ones, which provide certain incentives to persons who act in accordance with the principles and norms of the environment, the direct instruments require the legally binding behavior of all or some of the categories of persons in order to protect the environment. The paper deals with the direct instruments of public legal origin, such as legal prohibitions and orders, as well as the control and repressive instruments by the state administration bodies. The author points out the character and necessary connection between these instruments. Preventive legal prohibitions are thus necessarily linked to the permissions of administrative authorities, while repressive prohibitions are linked to the individual or the group exemptions from their application. Сажетак: Циљеви и принципи права животне средине се остварују преко одговарајућих правних и других инструмената којима се обезбеђује пожељно понашање одговарајућих субјеката. По своме карактеру ти инструменти могу бити директни и индиректни. За разлику од индиректних, којима се пружају одређени подстицаји лицима која се понашају у складу с принципима и нормама права животне средине, директним инструментима се налажу правно обавезујућа понашања свих или појединих категорија лица, а у циљу заштите животне средине. У раду се разматрају директни инструменти јавноправног карактера, као што су законске забране и налози, али и контролни и репресивни инструменти органа државне управе. Ауторка указује на ка- рактер и неопходну повезаност ових инструмената. Превентивне законске забране су тако нужно повезане са дозволама управних власти, док су репресивне забране повеза- не са појединачним или групним ослобођењима од њихове примене.
