o:4509 Право на прекограничну сарадњу децентрализованих јединица у Србији The right to transfer co-operation of decentralized units in Serbia sr Abstract: Cross-border cooperation in Europe has great significance and even greater opportunities, especially in a situation where state borders become flexible, and economic and social needs overcome national frameworks. The Constitution of Serbia guarantees the right to crossborder cooperation with the units of local self-government and autonomous provinces. This right represents a component of their autonomy, or selfmanagement. Although the constitutional guarantee is identical, the nature of these units requires different legal precision of the rights to cross-border cooperation. It is subject to certain limitations, in respect of which a number of contentious issues have emerged in the immediate past, which, despite constitutional intervention, have not been resolved today unambiguously. In this regard, it is necessary to refer to the legal framework of this issue, which is determined by the Constitution, laws and the Statute of APV, and in particular the views of the Constitutional Court, which are the framework and guidelines for determining the content and the form of the right to cross-border cooperation. Сажетак: Прекогранична сарадња у Европи има велики значај и још веће могућности, посебно у ситуацији када државне границе постају флексибилне, а економске и друштвене потребе превазилазе националне оквире. Устав Србије гарантује право на прекограничну сарадњу јединицама локалне самоуправе и аутономним покрајинама. То право представља компоненту њихове аутономности, односно самоуправности. Иако је уставна гаранција идентична, природа ових јединица захтева различита законска прецизирања права на прекограничну сарадњу. Оно подлеже извесним огра- ничењима, у погледу којих се у непосредној прошлости јавио низ спорних питања, која, упркос уставносудској интервенцији, ни данас нису недвосмислено решена. С тим у вези неопходно се осврнути на правни оквир овог питања која је утврђен Уставом, законима и Статутом АПВ, а посебно на ставове Уставног суда који представљају оквир и смерницу за утврђивање садржаја и форме права на прекограничну сарадњу.
