o:4492 Компаративни приказ института споразума о признању прекршаја у Сједињеним Америчким Државама, Немачкој и Србији Comparative representation of the institute of plea bargaining of minor offence in the United States of America, Germany and Serbia sr Abstract: Plea bargaining of minor offence is a specificity that is reflected by the fact that in the circumstances stipulated by the law, the defendant and the authorized applicant, with the existence of mutual will, negotiate the type of misdemeanor sanction after the defendant accepts the misdemeanor liability. The positivelegal prediction of this institute is relatively new in domestic misdemeanor law, and therefore it needs to be further consolidated. Although some procedural segments of this institute raises questions of its justification, especially the purpose of punishment due to the possibility of agreement on the height and type of sanction, its application is more and more widespread in our country and in the world. The significance of the application of this institute is that the procedural efficiency of the court procedure is achieved, the reduction of court costs and the less process burden on process entities. The aim of this research is to point out the positivelegal prediction of this institute in the Law on Misdemeanors in Serbia with a parallel presentation of how the plea bargaining is foreseen in the German legislation and legislation of the United States. Сажетак: Споразум о признању прекршаја представља специфичност која се огледа у томе што у законом предвиђеним околностима, окривљени и овлашћени подносилац захтева, уз постојање обостране воље преговарају око висине и врсте прекр- шајне санкције, након што окривљени прихвати прекршајну одговорност. Позитивно-правно предвиђање овог института релативно је ново у домаћем прекршајном праву, те стога га је потребно додатно сагредавати. Иако поједини процесни сегменти овог института покрећу питања његове оправданости, посебно сврхе кажњавања услед могућности договора око висине и врсте санкције, његова примена је све распрострањенија како код нас, тако и у свету. Значај примене овог института је у томе што се постиже процесна ефикасност судског поступка, смањење трошкова суда и мање процесно оптерећење процесних субјеката. Циљ овог истраживања је да се укаже на позитивноправно предвиђање овог института у Закону о прекршајима у Србији са упоредном приказом на који начин се споразум о признању прекршаја предвиђа у Немачком законодавству и законодавству Сједињених Америчких Држава.
